The Terms and Conditions (“Terms”) is a legal agreement between you and Oserio (the “Company”), and governs your use of Oserio website, mobile app or any applications or software (“Oserio Service”). You acknowledge that you have read, understood, and agree to be bound by the policies, terms, and conditions set forth below. If you do not agree to the Terms and privacy policy below, please do not use Oserio Services. Oserio has the right to revise these policies, terms, and conditions at any time by updating this posting, and your use after such change signifies your acceptance of the changed terms. Please check the Terms periodically for changes. IF YOU DO NOT AGREE WITH ANY OF THESE TERMS, THEN DO NOT DOWNLOAD, USE OR ACCESS ANY DEVICE, WEBSITE OR OSERIO APP.
1. Requirements for Use of the Oserio Services.
The Oserio Services are available for individuals aged 13 years or older. If you are 13 or older but under the age of 18, you should review this Terms with your parent or guardian to make sure that you and your parent or guardian understand it. Full use of the Oserio Services includes Oserio Products, Internet access, O’care (“the APP”) and certain software; may require periodic updates; and may be affected by the performance of these factors. The Oserio Services is not a guaranteed part of any third party product or service offering, and no purchase or obtaining of any third party product or service shall be construed to represent or guarantee you access to the Oserio Services.
2. System Requirements.
Use of the Oserio Service requires a personal computer, mobile devices such as a tablet, smart phone or other hardware device capable of Bluetooth and Internet connectivity and Internet or WiFi access (“Computer”) that you have to acquire separately from third parties. Your ability to use the Oserio Service may be affected by the performance of your Computer. You acknowledge and agree that all such system requirements, which may be changed from time to time, are your responsibility. For most effective use of the Oserio Service, high-speed Internet access is strongly recommended.
3. License Terms.
The Company grants you a limited license to access and make personal use of Oserio Service and not to modify it, or any portion of it, except with the express written consent of Company. Oserio Service or any portion of the Service may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without the express written consent of Company.
4. Registration, Account and Password.
Privacy Policy You have to establish an account ("Account") in order to use certain aspects of the Oserio Service. You are responsible for maintaining the confidentiality and security of your Account. You should not reveal your Account information to anyone else or use anyone else's Account. You are entirely responsible for all activities that occur on or through your Account, and you agree to immediately notify Oserio of any unauthorized use of your Account or any other breach of security. Oserio is not responsible for any losses arising out of the unauthorized use of your Account. Oserio reserves the right to terminate, disable or not provide all normal features for a particular Account if Oserio suspects or becomes aware of any unauthorized or unpermitted use of such Account or any part of the Oserio Service. You are responsible for maintaining the confidentiality of your login information and password. You shall be responsible for all uses of your login information, whether or not authorized by you. You agree to immediately notify us of any unauthorized use of your login information or password. Oserio cannot and does not assume any responsibility or liability for any information submitted by someone who has fraudulently accessed your Oserio Service account or for any third party's fraudulent use or misuse of information submitted by you. You represent that the information that you provide about yourself as requested in the account of Oserio Service registration form (the "Registration Data") is accurate and complete, and you agree to update your account information, as necessary, including providing Oserio with your current email address, so that you may receive notifications and other account-related communications.
5. Security.
You agree that you will not attempt to, or encourage or assist any other person to, circumvent, modify, reverse-engineer, decompile, disassemble or otherwise tamper with any security technology or software that is part of the Oserio Service or is used to monitor or enforce these Terms. Oserio may implement digital rights management ("DRM") or other similar security systems that contain measures designed to prevent unauthorized copying of software used with, accessed through or obtained via the Oserio Service. You shall not access or attempt to access an Account that you are not authorized to access. Violations of system or network security may result in civil or criminal liability.
6. Third Party Materials and Web Sites.
Certain content and services available through the Oserio Service may include materials from third parties. In addition, the APP may provide links to certain third party web sites or services. The Company is not responsible for examining or evaluating the content or accuracy of any such third party material or web sites. The Company does not warrant or endorse any third party web sites, services or content. The Company does not assume, and will have no liability or responsibility for any third party products, services, content, materials or web sites. Links to other web sites are provided solely as a convenience to you. You agree that you will not use any third party products, services, web sites or other materials in a manner that would infringe or violate the rights of any other party, and that Oserio has no liability or responsibility for your use of any third party products, services, web sites or other materials. You agree to defend, indemnify and hold harmless Oserio and its affiliates, and their respective officers, directors, employees, agents, and representatives from any and all claims arising out of your use of any third party products, services, web sites, or material of any kind.
7. Copyright.
All content included on this site and the APP, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Company and is protected by international copyright laws. The compilation of all content on this site is the exclusive property of Company and is protected by international copyright laws. All software used on this site is the property of Company or its software suppliers and is protected by international copyright laws. If you feel that any content posted on the Oserio Services infringes your copyrights or other intellectual property rights, please notify us by sending an email to our support.
8. Compliance with Laws.
The Oserio Service is operated by Oserio from its headquarter in Taichung, Taiwan. You agree to comply with all local, and national laws, statutes, ordinances and regulations that apply to your use of the Oserio Service.
9. Termination.
These Terms and all rights and licenses granted herein are effective from the time you accept these Terms until these Terms are terminated. You may terminate these Terms at any time by permanently ceasing your use of the Oserio Service and closing your Account, provided that the Terms shall continue to govern any past use the Oserio Service and Account. The Company may update, suspend or terminate your use of the Oserio Service and Account effective immediately if you breach these Terms or with reasonable notice to you and subject to any warranty claims you may have in case of termination. All obligations of confidentiality and restrictions on use, and all other provisions that may reasonably be interpreted to survive termination of these Terms, will survive termination of these Terms, regardless of the reasons for termination. Upon termination, you agree to cease all use of the Oserio Service. If you fail to comply with any of the provisions of these Terms, including, but not limited to, failing to provide Oserio with accurate and complete Registration Data, failing to keep your Registration Data private, or infringing or otherwise violating the rights of any third party, Oserio, at its sole discretion, without notice to you may: (i) terminate these Terms; (ii) terminate all rights of your Account; and (iii) preclude you from accessing the Oserio Service or any part of it.
10. Disclaimer of Warranties and Liability Limitations.
THIS SITE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS SITE ARE PROVIDED BY COMPANY ON AN “AS IS” AND “AS AVAILABLE” BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. COMPANY MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS SITE OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS SITE, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF THIS SITE IS AT YOUR SOLE RISK.
11. Licensee Outside Taiwan.
If you are located outside Taiwan, then you are responsible for complying with any local laws in your jurisdiction which might impact your right to import, export or use the Software, and you represent that you have complied with any regulations or registration procedures required by applicable law to make this license enforceable.
